Court Likely to Reject Alabama English Drivers License Exam

On March 25, the federal Court of Appeals in Atlanta, Georgia, listened to lawyers argue about whether Alabama could give driver license examinations only in English. Alabama voters passed an official English initiative in 1990 with 90% approval, the highest total for any English initiative.

The three judges of the U.S. Court of Appeals for the Eleventh Circuit gave every indication they would strike down the Alabama rule. Only a few seconds into Alabama Assistant Attorney General Jack Park's presentation, Presiding Judge Frank Hull interrupted Park to ask when he would settle the case by dropping the English rule. Later Judge Hull told the lawyers that the judges had already made up their minds that the English rule was illegal, and only wanted to hear about a "state's rights" issue of federal regulatory power.

A final decision is expected within the next few months. Park has indicated that Alabama will appeal if the English rule is struck down.
